We respect the privacy rights of users and recognize the importance of protecting information collected about you. This Privacy Policy ("Policy") explains how Bevy Labs, Inc. and its subsidiaries and affiliated companies (collectively “Bevy”, “we“, “our” or “us“) collects, uses, and shares personal information about you and how you can exercise your privacy rights.
If you are located in the European Economic Area ("EEA"), United Kingdom ("UK") or Switzerland (collectively "Europe"), the controller of the personal information that Bevy processes for the purposes described in this Policy is Bevy Labs, Inc.
This Policy applies to the processing of personal information collected by Bevy in the usual course of business, including:
- when you visit, interact with or use any of our websites (including www.bevy.com and https://cmxhub.com/) (“Websites”); visit or interact with our social media pages or public forums (such as our blogs); submit contact forms or job applications; receive online advertisements, marketing, or sales communications from Bevy, including emails, phone calls and texts; or through our Websites register for and attend our events, tutorials, webinars or contests (we collectively refer to these activities as our "Marketing Activities").
- when you purchase or use certain Bevy products or services as an authorized end user (for example, as an individual customer or as an authorized user of one of our business customers) as well as the information we collect when one of our business customers operates our services for you (herein referred to as "Service Users"), (collectively, “Bevy Services”), when Bevy acts as a data controller or business of your personal information only (not as a processor or service provider on behalf of our business customers, respectively).
"You" may, depending on the context, be a visitor to our Websites or social media pages; a recipient of our communications or online advertisements; a job applicant; or a Service User.
We may provide additional "just-in-time" disclosures or additional information about our data processing practices. These notices may supplement this Policy or clarify Bevy's privacy practices in the circumstances described or may provide you with additional choices about how Bevy processes your personal information.
This Policy does not apply to websites, products, or services that display or link to different privacy statements or that are operated by companies other than Bevy (including those operated by Bevy’s customers), or to business activities or practices of third parties.
When you engage with our Marketing Activities or use the Bevy Services, you acknowledge that you have read this Policy and understand its content. Your use of the Bevy Services and any dispute over privacy is subject to this Policy, any applicable service terms (including any applicable limitations on damages and the resolution of disputes).

3. The Personal Information We Collect
The personal information we collect depends on the context of your interactions with Bevy and the choices you make (including your privacy and browser settings), the Bevy Services you use, your location and applicable law, but can include the following:
Marketing Activities
Information You Provide To Us. We collect information you provide directly to us including when you visit our Websites. For example, when expressing an interest in obtaining information about Bevy or our services, subscribing to marketing or otherwise contacting us, we will collect personal information from you. The personal information we collect may include:
- Business Contact and Professional Information: such as your name, job title, organization, phone number, email address, postal address.
- Marketing Information: such as your contact preferences, newsletter subscription information, events registration information, and interests.
- Transactional and Payment Information: including your credit card numbers and associated identifiers, billing address.
- Nature and Content of Your Communications: when you contact us or we contact you, we collect any information that you provide, including the contents of the messages or attachments you send us.
- Job Application Information: if you apply for a job, we may collect certain personal information such as your resume, desired pay, education and work history, your current location, whether you are over the age of 18, and visa status. You also may choose to provide your gender, ethnicity, veteran status, disability status, and links to your website, blog, portfolio, or LinkedIn profile.
Information We Collect Automatically. When you visit our Websites or engage with our Marketing Activities, like most websites and companies, we use cookies and similar technologies to automatically collect certain technical information from your browser or device. To the extent that this automatically-collected data includes, or is linked to, personal information or personal data, we will treat such data in accordance with this Policy. We may automatically collect personal information about you, including:
- Usage Information: such as information about how you interact with our emails, Websites and other online forums (such as the pages and files viewed, searches, operating system and system configuration information and date/time stamps associated with your usage).
- Device Information: such as your device model, IP address, version of operating system, browser, identity of carrier and manufacturer, radio type (such as 4G), preferences and settings (such as preferred language), application installations, device identifiers, advertising identifiers, request information (speed, frequency, the site from which you linked to us), the name of the website you choose to visit immediately after ours, or information about other websites you have recently visited.
- Information We Collect through Social Media Features: our Websites may use social media features, such as the Facebook “like” button, the “Tweet” button and other sharing widgets (“Social Media Features”). You may be given the option by such Social Media Features to post information about your activities on a website to a profile page of yours that is provided by a third party social media network in order to share with others within your network. Social Media Features are either hosted by the respective social media network or hosted directly on our Websites. To the extent the Social Media Features are hosted by the respective social media networks and you click through to these from our Websites, the latter may receive information showing that you have visited our Websites. If you are logged in to your social media account, it is possible that the respective social media network can link your visit to our Websites with your social media profile. Your interactions with Social Media Features are governed by the privacy policies of the companies providing the relevant Social Media Features. Information We Collect from Other Sources. In order to enhance our ability to provide relevant marketing, offers and services to you and update our records, we may obtain information about you from other sources, such as our business customers, public databases, marketing partners, financial service providers, affiliate programs, data providers, Social Media Features as noted above, as well as from other third parties.
This information may include mailing addresses, job titles, email addresses, phone numbers, financial information (such as payment, transaction and fraud detection information), intent information (or user behavior information), market segment, IP addresses, social media profiles, social media URLs and custom profiles, for purposes of targeted advertising, event promotion and optimizing our Bevy Services and Marketing Activities. We may combine this personal information with other information we collect about you through our Bevy Services and Marketing Activities.
Bevy Services
Information You Provide to Us. If you are a Service User, you may provide certain personal information to us through the Bevy Services – for example, when you create an account with Bevy, when you consult with customer support or send us an email or communicate with us in any way (for example, to make a support request).
The personal information we collect may include:
- Business Contact and Professional Information: such as your name, job title, organization, phone number, email address, postal address.
- Account Log-in Credentials: such as your email or username and password when you sign-up for an account with us and the unique Service User assigned to you in our systems.
- Troubleshooting and Support Information: which is data you provide or we otherwise access in connection with support queries we receive from you. This may include, for example, contact or authentication data, the content of your chats and other communications with Bevy, and the product or service you are using related to your help inquiry.
- Marketing Information: such as your contact preferences, newsletter subscription information, events registration information, and interests.
- Transactional and Payment Information: including Bevy Services purchased or subscribed to, your credit card numbers and associated identifiers, billing address.
- Nature and Content of Your Communications: when you post or share user-generated content, or when you contact us or we contact you, we collect any information that you provide, including the contents of the messages or attachments you send. Information We Collect Automatically. When you use or interact with the Bevy Services, we automatically collect or receive certain information through the Bevy Services (for example in log files) and through other technologies (such as cookies) about your device and usage of the Bevy Services.
To the extent that this automatically-collected data includes, or is linked to, personal information or personal data, we will treat such data in accordance with this Policy. For further information on our use of cookies and similar technologies please review our Cookie Policy.
We may automatically collect personal information about you, including:
- Usage and Log Information: we monitor user activity in connection with the Bevy Services and may collect information about the features you use, the content you upload, download, share, or access while using the Bevy Services, and any actions taken in connection with the access and use of your content in the Bevy Service.
- Device Information: such as your device model, IP address, hardware settings, browser type, browser language, the date and time of your visit, and the referral URL.
- Location Information: such as information about your device's location, which can be either precise or imprecise. How much of this information we collect depends on the type and settings of the device you use to access the Bevy Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your location setting on your device.
- Inferences: we infer new information about you and the business customer from information we collect, including using automated means to generate information about your likely preferences, your service and product needs or other characteristics. For example, we infer your city, state, and country location based on your IP address.
Information We Process on Behalf of our Business Customers. We process certain personal information about Service Users on behalf of our business customers (where we act as a data processor or service provider on their behalf). This personal information may include usage data such as first name, last name, email, profile picture and user ID from the social platform used to create an account. As described above, in most cases, we only process this personal information on behalf of and as instructed by our business customers (the data controllers of the personal information).
However, where permitted by the relevant business customer and applicable law, we may leverage certain personal information collected through the operation of the Bevy Services for our internal research and development purposes to develop and improve our Marketing Activities and the Bevy Services (for which we will be a data controller). For these purposes, we only use personal information in a de-identified form that does not specifically identify any particular Service User (for example, by reference to their name or other identification information). For example, we may leverage de-identified information to train our models and algorithms, to make more consistent measurements and therefore to improve the functionality and accuracy of our Marketing Activities and the Bevy Services.
4. How We Use Your Personal Information
We use and process the personal information identified above for the purposes and on the legal bases identified below.
Marketing Activities
- Sending Marketing Communications: we will process your personal information to send you marketing information, product recommendations and other non-transactional communications (e.g., marketing newsletters, telemarketing calls, SMS, or push notifications) about Bevy when this is in accordance with your marketing preferences, including information about our Bevy Services, promotions or events as necessary for our legitimate interest in conducting direct marketing or to the extent you have provided your prior consent.
- Displaying Personalized Advertisements and Content: we process your personal information to conduct marketing research, advertise to you, provide personalized information about us on and off our Websites and to provide other personalized content based upon your activities and interests to the extent it is necessary for our legitimate interest in supporting our Marketing Activities or, where necessary, to the extent you have provided your prior consent.
- Processing Job Applications: we process your personal information if you apply for a job with Bevy, to evaluate your application and make hiring decisions, communicate with you and inform you of current and future career opportunities (unless you tell us that you do not want us to keep your details for such purposes), manage and improve our recruiting and hiring processes, or to conduct reference and background checks where required or permitted by applicable local law. We perform this processing to the extent that it is necessary to comply with our legal obligations, for our legitimate interest in assessing the suitability of our candidates and managing our recruiting process, or, where required by applicable law, with your consent.
- Complying with Legal Obligations: we process your personal information when cooperating with public and government authorities, courts or regulators in accordance with our legal obligations under applicable laws to the extent this requires the processing or disclosure of personal information to protect our rights or is necessary for our legitimate interest in protecting against misuse or abuse of our Websites, protecting personal property or safety, pursuing remedies available to us and limiting our damages, complying with judicial proceedings, court orders or legal processes or to respond to lawful requests. Where we need to collect and process personal information by law, or under a contract we have entered into with you, and you fail to provide the required personal information when requested, we may not be able to perform our contract with you.
Bevy Services
- Providing, Operating and Maintaining the Bevy Services: we process your personal information to perform our contract with you for use of the Bevy Services in order to provide you with the necessary functionality required during your use of the Bevy Services; to fulfil our obligations under applicable Terms of Service; or where we have not entered into a contract with you, we base the processing of your personal information on our legitimate interest to operate and administer the Bevy Services. Examples include, processing your personal information for the creation or administration of your Bevy account.;
- Communicating With You About the Bevy Services: we may send you technical notices, purchase confirmations and invoices, support and administrative messages, and other administrative or technical email, messages and other types of notifications (such as distribution and product updates and product patches and fixes) in reliance on our legitimate interests in administering the Bevy Services and providing certain features. These communications are considered part of the Bevy Services and in most cases you cannot opt-out of them. If an opt-out is available, you will find that option within the communication itself or in your account settings.
- Providing Customer Support: we work hard to provide the best experience possible, including supporting you when you need it. If you fill out a “Contact Us” web form or request Service User support, or if you contact us by other means including via a phone call, we process your personal information to perform our contract with you and/or (if we have not entered into a contract with you) to the extent it is necessary for our legitimate interest in fulfilling your requests and communicating with you.
- Maintaining the Security and Safety of the Bevy Services: we process your personal information by tracking use of the Bevy Services, creating aggregated, non-personal data, verifying accounts and activity, investigating suspicious activity and enforcing our terms and policies, to the extent this is necessary for our legitimate interest in promoting the safety and security of the Bevy Services, systems and applications and in protecting our rights and the rights of others.
- Developing and Improving the Bevy Services: we are always working to improve your experience and provide you with new and helpful features. We process your personal information to analyze trends and to track your usage of and interactions with the Bevy Services to the extent it is necessary for our legitimate interest in developing and improving our Bevy Services and providing you with more relevant content and service offerings, or where we seek your valid consent.
- Reviewing Compliance With Applicable Terms: we process your personal information to review compliance with our contract with you or your organization (where applicable) to the extent that it is in our legitimate interest to ensure adherence to the relevant terms.
- Complying With Legal Obligations: we process your personal information when cooperating with public and government authorities, courts or regulators in accordance with our legal obligations under applicable laws to the extent this requires the processing or disclosure of personal information to protect our rights or is necessary for our legitimate interest in protecting against misuse or abuse of our Bevy Services, protecting personal property or safety, pursuing remedies available to us and limiting our damages, complying with judicial proceedings, court orders or legal processes or to respond to lawful requests. Where we need to collect and process personal information by law, or under a contract we have entered into with you, and you fail to provide the required personal information when requested, we may not be able to perform our contract with you.

5. Sharing and Disclosure of Your Personal Information
We do not sell or share personal information about you with third parties except as described below. We may share personal information about you:
- Among our Affiliates: we may share your personal information with our affiliates, which include companies owned by or under common ownership of Bevy such as CMX, all of which will be required to use your personal information as described in this Policy.
- To Vendors, Consultants, and other Service Providers: in order to provide the Bevy Services and undertake our Marketing Activities, we may share your information with third-party vendors, consultants, and other service providers who are working on our behalf and require access to your information to carry out that work, such as cloud hosting providers to provide data storage and processing services, communication providers to process new queries and to manage our emails, payment providers to process billing or as it relates to a product feature, and analytics companies to perform analysis on the Bevy Services and Marketing Activities. These service providers are authorized to use your personal information only as necessary to provide services to Bevy.
- To Partners and Advertising Partners: we may share your personal information with our partners for their own marketing purposes and we may partner with third parties and share your personal information with them, including advertising networks, exchanges and social media platforms (like Facebook), to display advertising on and off our Websites or to manage and service advertising on other sites. - In Compliance With Laws: we may disclose your information to a third party: (a) if we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process, or governmental request; (b) to enforce our agreements and policies; (c) to protect the security or integrity of the Bevy Services; (d) to protect Bevy, our customers, or the public from harm or illegal activities; (e) to respond to an emergency which we believe in the good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person; or (f) as otherwise directed by you.
- For our Vital Interest and Legal Rights: we may disclose information where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which we may be involved.
- For Business Transfers: we may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. You may be notified thereafter via email of any such change in ownership or control of your personal information.
- With Your Consent: with your consent or upon your direction, we may disclose your personal information with any other third party or for other purposes.
We may also share aggregated or de-identified usage data with third parties to help us perform analysis and make improvements. Additionally, we may share anonymous usage data on an aggregate basis in the normal course of operating our business; for example, we may share information publicly to show trends in the use of the Bevy Services.
Any personal information or other information you choose to submit in communities, forums, blogs, or chat rooms may be read, collected, and used by others who visit these forums, depending on your account settings.

6. International Transfers of Your Personal Information
Personal information we collect may be stored and processed in your region, in the United States or in any other country where we or our affiliates, subsidiaries or service providers maintain facilities. Bevy is a US-based company. Our group affiliates and third-party service providers and partners operate around the world. Some jurisdictions have data protection laws that are different from the laws where you are located (and, in some cases, may not be as protective), and may be subject to access requests from governments, courts, or law enforcement according to applicable laws. We endeavor to safeguard your personal information in accordance with this Policy and the requirements of applicable laws.
Where we are a party to a transfer of personal information originating in Europe to third countries and territories outside of Europe which have been formally recognized as providing an adequate level of protection for personal information, we rely on the relevant “adequacy decisions” and “adequacy regulations” from the European Commission, Swiss and UK authorities. This includes relying on the EU-U.S. Data Privacy Framework, the UK Extension to the EU-U.S. Data Privacy Framework, and the Swiss-U.S. Data Privacy Framework.
Where the transfer is not or cannot be subject to an adequacy decision, we take appropriate safeguards to ensure that your personal information will remain protected in accordance with this Policy and applicable laws. These safeguards include implementing the European Commission’s Standard Contractual Clauses as issued on 4 June 2021 under Article 46(2) GDPR for transfers originating in the EEA and Switzerland; and the UK Addendum under Article 46(2) of the UK GDPR for the transfer of data originating in the UK.
Our Standard Contractual Clauses entered into by our group companies and with our third-party service providers and partners can be provided upon request. EU-US Data Privacy Framework, UK Extension and Swiss-US Data Privacy Framework
Bevy Labs, Inc. (for the purposes of this section, “Bevy”, “we”, or “us”) has certified to the U.S. Department of Commerce that we adhere to: (i) the EU-U.S. Data Privacy Framework Principles with regards to the processing of personal information received from the EEA in reliance on the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), (ii) the UK Extension to the EU-U.S. DPF with regards to the processing of personal information received from the UK (and Gibraltar), and (iii) the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) with regards to the processing of personal information received from Switzerland in reliance on the Swiss-U.S. DPF (collectively, the "DPF" and the “DPF Principles”).
The Federal Trade Commission has jurisdiction over our compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. If there is any conflict between the terms in this Policy and the DPF Principles, the DPF Principles shall govern. The types of personal information we receive in the United States, as well as the purposes for which we collect and use it, are set out in Sections 3 and 4 above. We will give you an opportunity to opt out where personal information we control about you is to be disclosed to an independent third party or is to be used for a purpose that is materially different from those set out in this Policy. If you otherwise wish to limit the use or disclosure of your personal information, please contact us via the contact details set out below.
Information about the types of third parties to which we disclose personal information and the purposes for which we do so are described in Section 5 above. If we have received your personal information in the United States and subsequently transfer that information to a third party acting as an agent, and such third party agent processes your personal information in a manner inconsistent with the DPF Principles, we will remain liable unless we can prove we are not responsible for the event giving rise to the damage.
Please note that, under certain circumstances, we may be required to disclose your personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
If you are located in Europe, you have the right to request access to the personal information that we hold about you and request that we correct, amend, or delete it if it is inaccurate or processed in violation of the DPF Principles. If you would like to exercise these rights, please write to us at the contact details provided below. We may request specific information from you to confirm your identity and we will respond to your request in accordance with the DPF Principles and applicable data protection laws. You may also opt-out of receiving marketing communications from us by writing to us at the contact details provided below or by clicking on the “unsubscribe” or “opt-out” link in the marketing emails we send you.
Bevy commits to resolve complaints about our collection or use of your personal information. European individuals with inquiries or complaints regarding our handling of personal information received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF should first contact Bevy us using the contact details provided below. We will investigate and attempt to resolve any DPF-related complaints or disputes within forty-five (45) days of receipt.
If you have an unresolved DPF complaint that we have not addressed satisfactorily, we have committed to refer unresolved DPF complaints to JAMS which is an independent dispute resolution body located in the United States. Under certain conditions, you may be entitled to invoke binding arbitration for the resolution of your complaint. We reserve the right to amend this section from time to time consistent with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF requirements.
7. Security of your Personal Information
Bevy takes reasonable precautions, including organizational, technical, and physical measures, to help safeguard your personal information against accidental or unlawful destruction, loss, misuse, and unauthorized access, disclosure, alteration, and destruction. However, no security measure or modality of data transmission over the Internet is 100% secure. Although we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security. You are solely responsible for protecting your password, limiting access to your devices, and signing out of websites after your sessions.
To protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person. Please advise us immediately if you believe your password has been compromised in any way. In addition, always log out and close your browser when you finish your session. 8. How Long we Store your Personal Information
We retain your personal information where we have an ongoing legitimate business need to do so and for a period of time consistent with the original purpose as described in this Policy.
We determine the appropriate retention period for personal information on the basis of the amount, nature and sensitivity of your personal information processed, the potential risk of harm from unauthorized use or disclosure of your personal information and whether we can achieve the purposes of the processing through other means, as well as on the basis of applicable legal requirements (such as applicable statutes of limitation). For example, we retain personal data as needed to maintain appropriate business and financial records, protect our legal interests, resolve disputes, or comply with legal or regulatory requirements. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize your personal information or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information using appropriate security measures and take appropriate steps designed to isolate it from any further processing until deletion is possible.

9. Your Privacy Rights and Choices
Bevy provides ways for you to access and delete your personal information as well as exercise other rights that give you certain control over your personal information.
All users
Account Information. You may update, correct, or delete information about you at any time by logging into your product account and modifying your information, or by emailing us at privacy@bevy.com. We will retain your personal information for the period necessary to fulfil the purposes outlined in this Policy. If you wish to deactivate your product account, you can do so yourself in your user account settings.
Upon request, Bevy will provide you with information about whether we hold or process your personal information that we are aware of. To request this information, contact us at privacy@bevy.com.
Promotional and Newsletter Communications (Email Subscriptions). You may opt out of receiving promotional and newsletter emails from Bevy at any time by following the opt-out instructions provided in those emails. You may also opt-out of receiving promotional emails and other promotional communications from us at any time by emailing privacy@bevy.com with your specific request. We make every effort to promptly process all unsubscribe requests. If you opt out, we may still send you non-promotional communications, such as security alerts and notices related to your access to or use of the Bevy Services or those about your account or our ongoing business relations.
Cookies. You can modify your cookie preferences in our [Cookie Preference Center / Cookie Settings] or on your browser, but if you delete or choose not to accept some of the cookies, you may lose certain functionality and features.
European residents and visitors
If you are a resident of or visitor from Europe, where we are acting as a data controller, you may have the following rights with regard to the personal information we control about you:
- You can access, correct, update and delete your personal information by emailing us at privacy@bevy.com.
- You can object to processing of your personal information, ask us to restrict the processing of your personal information or request portability of your personal information. To exercise these rights, please send an email to privacy@bevy.com.
- If we have collected and processed your personal information with your consent, then you can withdraw your consent at any time for future processing.
